1. Trial period

On 30 April 2015 (decisions number 39882 and 40842), the Court of Appeal changed its position regarding the rules on the trial period under Luxembourg law.

The Court of Appeal ruled that the notice period in case of the termination of the contract during the trial period starts to run on the day of the sending out of the termination letter, and not on the following day. This is particularly important in the scope of the termination of the trial period during sickness.

Furthermore, the Court of Appeal confirmed that in case the employee changes position within the same company (upon the employee’s request), a new trial period is enforceable, if the former and the new position of the employee are fundamentally different. The Court of Appeal underlined that this principle applies notwithstanding the fact that the employee’s seniority is taken over. In the same logic, the Court of Appeal confirmed the validity of a trial period as part of a second employment contract which had been concluded for the same position 3 months after the termination of the first employment contract by the employer (decision dated 8 June 2015, number 41691).

2. Authorisation to stay – highly qualified worker

An employee is considered a highly qualified worker if he is entitled to, amongst others, a gross annual salary of at least 1.5 times the yearly average gross salary determined by the government. In 2014, this was a gross amount of EUR 69,858. The regulation dated 13 May 2015, published on 2 June 2015, increased this gross annual amount to EUR 71,946 for 2015.

3. Authorisation to stay – transferred worker

The directive 2014/66/EU of 15 May 2014 on the conditions of entry and residence of third-country nationals in the framework of an intra-corporate transfer will, upon its implementation into Luxembourg law, introduce changes in the scope of authorisations to stay for intra-group transfers. Currently, such an authorisation can be extended up to a maximum of 5 years. The implementation of the aforementioned directive will limit the extension period to a maximum of 3 years and introduce new measures of mobility within the scope of the immigration rules and regulations.


Nouveautés

1. Période d’essai

En date du 30 avril 2015 (arrêts numéros 39882 et 40842 du rôle), la Cour d’appel a procédé à un revirement de la jurisprudence existante en ce qui concerne la période d’essai.

La Cour a ainsi décidé que lors d’un licenciement pendant la période d’essai, le préavis débute le jour de l’envoi de la lettre de licenciement, et non plus le lendemain suivant l’envoi de la lettre. Ceci est particulièrement important en cas de résiliation de la période d’essai pendant la maladie.

Par ailleurs, la Cour a confirmé qu’une nouvelle période d’essai dans le cadre d’un nouveau poste au sein de la même entreprise/chez le même employeur (pour lequel le salarié a postulé) est valable, si l’ancienne et la nouvelle fonction du salarié sont fondamentalement différentes. La Cour a précisé que ce principe s’applique, nonobstant le fait que l’ancienneté du salarié est reprise dans le cadre du changement de fonction. Dans la même logique, la Cour d’appel a considéré valable une période d’essai prévue par un second contrat de travail pour le même poste et conclu 3 mois après la résiliation du premier contrat de travail par l’employeur (arrêt du 8 juin 2015, numéro 41691 du rôle).

2. Autorisation de séjour – salarié hautement qualifié

Est considéré comme travailleur hautement qualifié le salarié qui, entre autre, touche une rémunération au moins égale à un montant correspondant au moins à 1,5 fois le salaire annuel brut moyen. Le seuil applicable en 2014 était de EUR 69.858. Le règlement ministériel du 13 mai 2015 déterminant le salaire annuel brut moyen, publié le 2 juin 2015, a augmenté ce seuil à EUR 71.946 brut/an pour 2015.

3. Autorisation de séjour – salarié transféré

La directive 2014/66/UE du 15 mai 2014 établissant les conditions d’entrée et de séjour des ressortissants de pays tiers dans le cadre d’un transfert temporaire intragroupe, dès sa transposition au Luxembourg, introduira des changements en matière d’autorisation de séjour pour le travailleur transféré. Actuellement, la durée du transfert intragroupe peut être prolongée jusqu’à 5 ans. La transposition de ladite directive limitera cette durée à 3 ans et introduira d’autres moyens de mobilité en matière d’immigration.


Neuerungen

1. Probezeit

Am 30. April 2015 (Entscheidungen Nummer 39882 und 40842) hat das Berufungsgericht entgegen der bisher konstanten Rechtsprechung die Regelungen zur Probezeit umgekehrt.

Das Berufungsgericht hat entschieden, dass die Kündigungsfrist im Rahmen einer Kündigung während der Probezeit am Tag des Absendens des Kündigungsschreibens beginnt und nicht wie bisher am Folgetag. Dies ist insbesondere im Rahmen der Kündigung während der Krankheit von Bedeutung.

Darüber hinaus hat das Berufungsgericht bestätigt, dass eine neue Probezeit bei einem Stellenwechsel (gewünscht vom Arbeitnehmer) innerhalb desselben Unternehmens durchsetzbar ist, wenn sich die alte und die neue Funktion des Arbeitnehmers fundamental unterscheiden. Das Gericht hat hervorgehoben, dass sich dieses Prinzip ungeachtet der Tatsache anwendet, dass die Betriebszugehörigkeit des Arbeitnehmers im Rahmen der Änderung des Tätigkeitsfeldes übernommen wird. In derselben Logik hat das Berufungsgericht auch eine Probezeit für durchsetzbar erklärt, die in einem zweiten Arbeitsvertrag, der 3 Monate nach Kündigung des ersten Vertrags durch den Arbeitgeber für genau denselben Posten geschlossen wurde, vorgesehen war (Entscheidung vom 8. Juni 2015, Nummer 41691).

2. Arbeitsgenehmigung – hochqualifizierter Arbeitnehmer

Ein Arbeitnehmer gilt als hochqualifiziert, wenn er, unter anderem, ein Bruttojahresgehalt in Höhe von mindestens des 1,5-fachen des jährlichen Durchschnittsjahresgehaltes erhält. 2014 war dies noch ein Betrag in Höhe von EUR 69.858. Die ministerielle Verordnung vom 13. Mai 2015, veröffentlicht am 2. Juni 2015, hat diesen Bruttobetrag auf EUR 71.946 für 2015 erhöht.

3. Arbeitsgenehmigung – Versetzter Arbeitnehmer

Die Richtlinie 2014/66/EU vom 15. Mai 2014 über die Bedingungen für die Einreise und den Aufenthalt von Drittstaatsangehörigen im Rahmen eines unternehmensinternen Transfers wird ab ihrer Umsetzung in das Luxemburger Recht Änderungen im Bereich der Arbeitsgenehmigung für konzernweite Versetzungen einführen. Momentan kann eine solche Genehmigung für bis zu 5 Jahre erteilt werden. Die Umsetzung der Richtlinie wird diese Dauer auf 3 Jahre limitieren und neue Maßnahmen zur Mobilität im Rahmen des Immigrationsrechts einführen.
