Telework of cross-border workers: extension of tax and social security agreements

Luxembourg has agreed to extend the agreements on tax treatment and social security with France and Belgium.

The agreements are extended as follows:

  • with France: until 30 September 2021 for tax treatment[1] and social security[2];
  • with Belgium: until 30 September 2021 as regards tax treatment[3] and until 31 December 2021 as regards social security[4].

Concerning the situation between Luxembourg and Germany, the mutual agreement of 3 April 2020[5] provides that the agreement will be automatically extended from month to month in the absence of denunciation by one of the competent authorities.

Thus, the days of telework performed continue not to be taken into account for:

  • the calculation of the tolerance thresholds for tax matters (i.e.: 24 days for Belgian cross-border workers, 19 days for German cross-border workers and 29 days for French cross-border workers);
  • the determination of the social security legislation applicable in order to avoid a change of affiliation in the event the 25% threshold is exceeded in accordance with European provisions.

Télétravail des frontaliers : prolongation des accords en matière fiscale et de sécurité sociale

Le Luxembourg a convenu de proroger avec d’une part, la France, et d’autre part, la Belgique, les accords en matière de traitement fiscal et en matière de sécurité sociale.

Les accords sont prorogés comme suit :

  • avec la France : jusqu’au 30 septembre 2021 en matière de traitement fiscal[1] et en matière de sécurité sociale[2] ;
  • avec la Belgique : jusqu’au 30 septembre 2021 en matière de traitement fiscal[3] et jusqu’au 31 décembre 2021 en matière de sécurité sociale[4].

Concernant la situation entre le Luxembourg et l’Allemagne, l’accord amiable du 3 avril 2020[5], prévoit que ledit accord est prolongé automatiquement de mois en mois en l’absence de dénonciation par l’une des autorités compétentes.

Par conséquent, les jours de télétravail effectués continuent à ne pas être pris en compte pour :

  • le calcul des seuils de tolérance applicables en matière fiscale (i.e. : 24 jours pour les travailleurs frontaliers belges, 19 jours pour les travailleurs frontaliers allemands et 29 jours pour les travailleurs frontaliers français) ;
  • la détermination de la législation de sécurité sociale applicable aux travailleurs afin d’éviter un changement d’affiliation en cas de dépassement du seuil des 25% conformément aux dispositions européennes.

Telearbeit von Grenzpendlern: Erweiterung der Abkommen im Bereich Steuern und Sozialversicherung

Luxemburg hat zugestimmt, die diesbezüglichen Abkommen über die steuerliche Behandlung und die soziale Sicherheit mit Frankreich und Belgien zu verlängern.

Die Vereinbarungen werden wie folgt verlängert:

  • mit Frankreichbis zum 30. September 2021 hinsichtlich der steuerlichen Behandlung[1] und der Sozialversicherung[2];
  • mit Belgien: bis zum 30. September 2021 hinsichtlich der steuerlichen Behandlung[3] und bis zum 31. Dezember 2021 hinsichtlich der Sozialversicherung[4].

Was die Situation zwischen Luxemburg und Deutschland betrifft, so sieht die Vereinbarung vom 3. April 2020[5] vor, dass diese automatisch von Monat zu Monat verlängert wird, außer, eine der Parteien kündigt die Vereinbarung.

Folglich werden die Tage der geleisteten Telearbeit weiterhin nicht berücksichtigt für:

  • die Berechnung der in Steuerangelegenheiten geltenden Toleranzschwellen (d.h.: 24 Tage für belgische Grenzgänger, 19 Tage für deutsche Grenzpendler, und 29 Tage für französische Grenzgänger);
  • die Bestimmung der für die Arbeitnehmer geltenden Sozialversicherungsregelung, um einen Wechsel der Zugehörigkeit bei Überschreiten der 25 % Schwelle gemäß den europäischen Vorgaben zu vermeiden.
