Telework of German cross-border workers: extension of tax agreement

Luxembourg has agreed to extend the tax agreement with Germany until 31 December 2021[1].

As a reminder, the agreement on social security agreed with Germany is also in force until 31 December 2021[2].

Thus, the days of telework performed continue not to be taken into account for:

  • the calculation of the tolerance threshold for tax matters (19 days);
  • the determination of the social security legislation applicable in order to avoid a change of affiliation in the event of the 25% threshold is reached or exceeded in accordance with European provisions.

Télétravail des frontaliers allemands : prolongation de l’accord en matière fiscale

Le Luxembourg a convenu de proroger avec l’Allemagne l’accord en matière fiscale jusqu’au 31 décembre 2021[1].

Pour rappel, l’accord en matière de sécurité sociale convenu avec l’Allemagne est également applicable jusqu’au 31 décembre 2021[2].

Par conséquent, les jours de télétravail effectués continuent à ne pas être pris en compte pour :

  • le calcul du seuil de tolérance applicable en matière fiscale (19 jours) ;
  • la détermination de la législation de sécurité sociale applicable aux travailleurs afin d’éviter un changement d’affiliation en cas d’atteinte ou de dépassement du seuil des 25% conformément aux dispositions européennes.

Telearbeit von deutschen Grenzgängern: Verlängerung des Steuerabkommens

Luxemburg hat zugestimmt, das Steuerabkommen mit Deutschland bis zum 31. Dezember 2021 zu verlängern[1].

Zur Erinnerung, das Sozialversicherungsabkommen mit Deutschland gilt ebenfalls bis zum 31. Dezember 2021[2].

Daher werden die geleisteten Telearbeitstage bis zu diesem Zeitpunkt weiterhin nicht berücksichtigt für:

  • die Berechnung der Toleranzschwelle für steuerliche Zwecke (19 Tage);
  •  
  • die Festlegung der für die Arbeitnehmer geltenden Sozialversicherungsvorschriften, um einen Wechsel der Zugehörigkeit zu vermeiden, wenn die 25 %-Schwelle gemäß den europäischen Bestimmungen erreicht oder überschritten wird.
