“3G” (vaccinated/recovered/tested) scheme mandatory in the workplace as of 15 January 2022

I. Scheme applicable from Saturday 15 January 2022
1. CONTROL OF THE CERTIFICATE:

– Obligation for employees, public agents, self-employed persons, as well as trainees, apprentices and pupils and students occupied during school holidays to be able to present at their place of work (≠ teleworking) one of the following certificates:

  • certificate of vaccination;
  • certificate of recovery;
  • certificate of 48-hour PCR negative or 24-hour rapid antigenic test;
  • certificate of contraindication to Covid-19 vaccination with negative test (PCR, antigenic or autotest performed on site).

→ No legal obligation for the employer to cover the cost of the tests.

– No notification of the scheme to the Health Directorate (“Direction de la Santé”).

– Possibility for the employer to decide that persons from outside the company (customers, suppliers, visitors, etc.) are also subject to the 3G scheme for all or part of the premises.

2. ORGANISATION OF THE DAILY CONTROL OF THE CERTIFICATE:

– Control by the employer or another person appointed by the employer.

– Verification of identity: the employer (or the person appointed by the employer) must ensure the identity of the person who presents the certificate by providing an identity document (any official document with a photograph).

– The Labour and Mines Inspectorate (“Inspection du travail et des Mines”, ITM) is responsible for monitoring compliance with the obligations of the employer and the employees.

– In the event of non-compliance with the control obligation, the employer is liable to an administrative fine of up to 4,000 EUR.

– The employee is liable to a criminal fine of between 500 and 1,000 EUR if he/she enters the workplace without a valid certificate.

– Introducing a list: the employer has the option of having a list of vaccinated or recovered employees under the following conditions:

  • voluntary registration in the list → it is recommended that the employee signs a declaration of consent;
  • content of the list limited to the name of the employee and the period of validity of the certificate;
  • possibility to request the removal from the list at any time and without justification;
  • possibility to delegate the management of the list;
  • the list’s validity is limited to the duration of the Law (28 February 2022 inclusive) and the list must be destroyed by that date.
3. IF THE EMPLOYEE REFUSES TO PRESENT A CERTIFICATE OR IS UNABLE TO PRESENT A VALID CERTIFICATE:
  • The employee will not be able to access his/her workplace.
  • The employee will be able to take statutory or contractual leave with the employer’s agreement.
  • The employer may adapt the employee’s workstation, e.g. by requiring him/her to telework, if this is still allowed and possible.

If no agreement is reached or if the employee does not wish to take days off, he/she loses part of the corresponding remuneration. → The employment contract is maintained and the non-submission of a valid certificate as well as the resulting absence from work is not a reason for dismissal or any other sanction. Otherwise = dismissal null and void.

4. IMPACT OF UNPAID ABSENCE ON SOCIAL SECURITY AND ON THE EMPLOYMENT CONTRACT:
  • Unpaid absence does not result in the employee’s disaffiliation from social security.
  • Social security contributions are not due, except for pension insurance (employer’s and employee’s share) up to a maximum of 64 hours.
  • The period of unpaid absence is assimilated to a period of actual work, in particular for the calculation of days of leave and for the rights related to seniority (e.g. a severance payment).
II. Transition period from 17 December 2021 to 14 January 2022 inclusive
  • Covid check scheme with tests: possibility for employers to place all or part of the company or certain events under the Covid check scheme with test certificate.
  • In order to enter a zone under this Covid check scheme, workers may have the same documents mentioned in point I.1.
  • Immediate application of the general Covid check provision concerning identity verification (content similar to what precedes) and of the above-mentioned provision related to the possibility of having a list of vaccinated and/or recovered employees.

In case of refusal or impossibility to present a certificate and/or to justify his/her identity, the person concerned will not be able to access the area placed under this Covid check regime (possible sanction during this transitional period to be assessed on a case by case basis).

N.B.: From 17 December 2021, application in company canteens of the new Covid check scheme (“2G”).


Régime des « 3G » (vacciné/rétabli/testé) obligatoire sur le lieu de travail à partir du 15 janvier 2022

I. Régime applicable à partir du samedi 15 janvier 2022
1. CONTRÔLE DU CERTIFICAT :

– Obligation pour les salariés, agents publics, travailleurs indépendants, ainsi que les stagiaires, les apprentis et les élèves et étudiants occupés pendant les vacances scolaires d’être en mesure de présenter sur leur lieu de travail (≠ télétravail) un des certificats suivants :

  • certificat de vaccination ;
  • certificat de rétablissement ;
  • certificat de test négatif PCR de 48 heures ou antigénique rapide de 24 heures ;
  • certificat de contre-indication à la vaccination à la Covid-19 accompagné d’un test négatif (test PCR, antigénique ou autotest réalisé sur place).

→ Pas d’obligation légale pour l’employeur de prendre en charge les frais des tests.

– Aucune notification du régime auprès de la Direction de la santé.

– Possibilité pour l’employeur de décider que les personnes externes à l’entreprise (clients, fournisseurs, visiteurs, etc.) soient également soumises au régime 3G pour tout ou partie des locaux.

2. ORGANISATION DU CONTRÔLE QUOTIDIEN DU CERTIFICAT :

– Contrôle par l’employeur ou une autre personne désignée par celui-ci.

– Vérification de l’identité: l’employeur (ou la personne désignée par lui) devra s’assurer de l’identité de la personne présentant son certificat au moyen de la présentation d’une pièce d’identité (tout document officiel muni avec une photographie).

– L’Inspection du travail et des mines (ITM) est chargée de contrôler le respect des obligations de l’employeur et des salariés.

– En cas de non-respect de l’obligation de contrôle, l’employeur s’expose à une amende administrative de 4.000 EUR maximum.

– Le salarié s’expose quant à lui à une amende pénale de 500 à 1.000 EUR en cas d’accès au lieu de travail sans certificat valide.

– Tenue d’une liste: l’employeur a la possibilité de tenir une liste des salariés vaccinés ou rétablis dans le respect des conditions suivantes : inscription volontaire sur la liste → il est recommandé de faire signer une attestation de consentement au salarié ;

  • contenu de la liste limité au nom de la personne et la durée de validité du certificat ;
  • possibilité de demander le retrait de la liste à tout moment et sans justification ;
  • possibilité de déléguer la tenue de la liste ;
  • durée de validité de la liste limitée à la durée de validité de la loi (28 février 2022 inclus) et obligation de détruire la liste à cette date.
3. EN CAS DE REFUS DU SALARIÉ DE PRÉSENTER UN CERTIFICAT OU D’IMPOSSIBILITÉ DE PRÉSENTER UN CERTIFICAT VALIDE :
  • Le salarié ne pourra pas accéder à son lieu de travail.
  • Le salarié pourra prendre avec l’accord de son employeur des jours de congé légal ou conventionnel.
  • L’employeur peut adapter le poste de travail du salarié en lui demandant de faire p.ex. du télétravail si cela est encore autorisé et possible.

En l’absence d’accord ou si le salarié ne souhaite pas prendre des jours de congé, il perd de plein droit la partie correspondante de sa rémunération → Le contrat de travail est maintenu et la non-présentation d’un certificat ainsi que l’absence au travail en résultant ne constituent pas un motif de licenciement ou de toute autre sanction. À défaut = licenciement nul.

4. INCIDENCE DE L’ABSENCE NON RÉMUNÉRÉE EN MATIÈRE DE SÉCURITÉ SOCIALE ET SUR LE CONTRAT DE TRAVAIL :
  • L’absence non rémunérée n’entraîne pas la désaffiliation du salarié à la sécurité sociale.
  • Les cotisations sociales ne sont pas dues, sauf pour l’assurance pension (part patronale et part salariale) jusqu’à maximum 64 heures.
  • La période de non-rémunération est assimilée à une période de travail effectif notamment pour le calcul des jours de congé et pour les droits liés à l’ancienneté de service.
II. Période de transition du 17 décembre 2021 au 14 janvier 2022 inclus
  • Régime Covid check avec tests : possibilité pour les employeurs de placer toute ou partie de l’entreprise, sinon certains évènements, sous le régime Covid check avec certificat de test.
  • Pour entrer dans une zone sous ce régime Covid check, les travailleurs peuvent se prévaloir des mêmes documents précités au point I.1.
  • Application immédiate de la disposition générale en matière de Covid check concernant la vérification d’identité (contenu similaire à ce qui précède) et de la disposition précitée relative à la possibilité de tenir une liste des salariés vaccinés et/ou rétablis.

En cas de refus ou d’impossibilité de présenter un certificat et/ou de justifier son identité, la personne concernée ne pourra pas accéder à la zone placée sous ce régime du Covid check (sanction possible durant cette période transitoire à apprécier au cas par cas).

N.B. : À partir du 17 décembre 2021, application dans les cantines d’entreprises du nouveau régime Covid check (« 2G »).


3G Regel (geimpft/genesen/getestet) zwingend am Arbeitsplatz ab 15. Januar 2022

I. Anwendbare Regelung ab Samstag, 15. Januar 2022
1. KONTROLLE EINES ZERTIFIKATS:

– Verpflichtung für Arbeitnehmer, Beamte, selbständig Tätige und Praktikanten, Lehrlinge sowie Schüler und Studenten während der Schulferien, eines der folgenden Zertifikate am Arbeitsplatz (≠ Telearbeitsplatz) vorzulegen:

  • Impfzertifikat;
  • Genesungszertifikat;
  • Negativer PCR Test (48 Stunden) oder Schnelltest (24 Stunden);
  • Zertifikat über die Unmöglichkeit einer Impfung gegen Covid-19, zusammen mit einem Negativtest (PCR, Schnelltest oder Selbsttest vor Ort).

→ Keine rechtsverbindliche Pflicht des Arbeitgebers, die Kosten für einen Test zu übernehmen

– Keine Mitteilung der 3G Anwendung gegenüber dem Gesundheitsministerium

– Möglichkeit des Arbeitgebers, zu entscheiden, dass externe Personen (Kunden, Lieferanten, Besucher, etc.) auch unter die 3G Regel fallen, dies für Teile oder das ganze Unternehmen

2. ORGANISATION DER TÄGLICHEN KONTROLLE EINES ZERTIFIKATS:

– Durch den Arbeitgeber oder einer anderen durch den Arbeitgeber bestimmten Person;

– Kontrolle der Identität: der Arbeitgeber oder eine andere durch den Arbeitgeber bestimmte Person muss die Identität der das Zertifikat vorlegenden Person durch Vorlage eines Ausweisdokumentes prüfen (offizielles Dokument mit Foto).

– Die Gewerbeinspektion (ITM) ist das Kontrollorgan für die Verpflichtung der Arbeitnehmer und Arbeitgeber

– Bei Nichtbeachtung durch den Arbeitgeber droht ein Bußgeld in Höhe von maximal 4.000 EUR
Arbeitnehmer setzen sich einer Geldbuße von 500 bis 1.000 EUR aus

– Anlegen einer Liste: der Arbeitgeber hat die Option, eine Liste der geimpften oder genesenen Arbeitnehmer zu führen, dies unter folgenden Bedingungen:

  • Freiwillige Einschreibung auf die Liste → es ist empfehlenswert, den Arbeitnehmern eine Zustimmungserklärung unterzeichnen zu lassen;
  • Inhalt der Liste beschränkt auf den Namen der Person und die Gültigkeitsdauer des Zertifikats;
  • Möglichkeit, jederzeit ohne Grund die Löschung von der Liste zu verlangen;
  • Möglichkeit die Führung der Liste zu delegieren;
  • Gültigkeitsdauer der Liste limitiert auf die Anwendbarkeit des Gesetzes (28. Februar 2022 einschliesslich), bevor die Liste zerstört werden muss
3. WEIGERUNG DURCH DEN ARBEITNEHMER, EIN ZERTIFIKAT VORZULEGEN ODER UNMÖGLICHKEIT, EIN GÜLTIGES ZERTIFIKAT VORZULEGEN:
  • Der Arbeitnehmer hat keinen Zutritt zum Arbeitsplatz.
  • Der Arbeitnehmer kann im Einvernehmen mit dem Arbeitgeber gesetzlichen oder vertraglichen Jahresurlaub nehmen.
  • Der Arbeitgeber kann den Arbeitsplatz anpassen und den Arbeitnehmer z.B. von zu Hause arbeiten lassen, falls dies gestattet und möglich ist.

Sollten Arbeitgeber und Arbeitnehmer keine gemeinsame Lösung finden oder wenn der Arbeitnehmer keinen Jahresurlaub nehmen möchte, verliert der Arbeitnehmer automatisch sein Recht auf Lohnzahlung → Der Arbeitsvertrag bleibt bestehen und die Nichtvorlage eines Zertifikats und die daraus resultierende Abwesenheit am Arbeitsplatz stellen keinen Kündigungsgrund oder einen Grund für die Anwendung einer anderen Sanktion dar. Andernfalls = Kündigung nichtig.

4. IMPAKT DER UNBEZAHLTEN ABWESENHEIT AUF DIE SOZIALVERSICHERUNG UND DEN ARBEITSVERTRAG:
  • Keine Abmeldung des Arbeitnehmers bei der Sozialversicherung
  • Sozialbeiträge sind nicht geschuldet, außer für den Rentenanteil (Arbeitgeber- und Arbeitnehmerteil), dies bis zu 64 Stunden.
  • Die unbezahlten Tage ist einer effektiven Arbeitszeit gleichgestellt, insbesondere für die Berechnung der Urlaubstage und der Betriebszugehörigkeit.
II. Übergangsbestimmungen vom 17. Dezember 2021 bis 14. Januar 2022 (einschliesslich)
  • Covid Check Regime mit Test: Möglichkeit für Arbeitgeber, das Unternehmen ganz oder teilweise oder bestimmte Veranstaltungen unter ein Covid Check Regime mit Testzertifikat zu stellen.
  • Um Zugang zu einer Covid Check Zone zu erhalten, müssen Arbeitnehmer dieselben Zertifikate wie oben unter I.1. vorlegen.
  • Sofortige Anwendbarkeit der generellen Bestimmung zum Covid Check bzgl. der Prüfung der Identität (ähnlich dem vorgenannten) und der vorgenannten Bestimmung bzgl. der Möglichkeit, eine Liste der geimpften und/oder genesenen Arbeitnehmer zu führen.

Im Falle der Weigerung oder Unmöglichkeit, ein Zertifikat vorzulegen und/oder die Identität nachzuweisen, kann die betroffene Person die Covid Check Zone nicht betreten (Sanktionen nach Einzelfallabwägung möglich).

N.B.: ab dem 17. Dezember 2021, Anwendbarkeit des neuen Covid checks in Betriebskantinen („2G“).
