Vacation days – public holidays

The draft bill number 7399 was unanimously adopted on 27 March 2019. Therefore, 9th May will from now on be a public holiday (11 public holidays in total) and the vacation days to be granted to the employees will be increased to 26 days per year (against 25 days so far).

The final legal provisions have not yet been published in the official Gazette. The provisions will nevertheless be applicable as of 1st January 2019: 9th May 2019 will thus be a public holiday and the employees will be entitled to a minimum of 26 vacation days in 2019 for a full-time employment.

It is recommended to review the wording in the employment contracts or any other agreements with respect to vacation days and/or rest days.


Congé légal – Jours fériés

Le projet de loi no 7399 a été voté à l’unanimité le 27 mars 2019. Par conséquent, la journée du 9 mai sera dorénavant fériée (11 jours fériés au total), et le nombre de jours de congé légal est d’au moins 26 jours (contre 25).

La loi qui n’est pas encore publiée sera applicable au 1er janvier 2019 : le 9 mai 2019 sera férié et les salariés ont automatiquement droit à au moins 26 jours de congé en 2019 pour une année complète travaillée à temps plein.

Il est conseillé de vérifier la rédaction des contrats de travail ou conventions, accords applicables prévoyant plus de jours de congé et/ou repos.


Gesetzlicher Jahresurlaub – gesetzliche Feiertage

Der Gesetzesentwurf Nr. 7399 wurde am 27. März 2019 einstimmig angenommen. Daher wird der 9. Mai ein gesetzlicher Feiertag (11 gesetzliche Feiertage im Ganzen) und der gesetzliche Mindesturlaub auf 26 Tage erhöht (gegenüber den bisherigen 25 Tagen).

Das Gesetz ist noch nicht veröffentlicht, wird aber ab dem 1. Januar 2019 anwendbar sein: der 9. Mai 2019 ist dann ein gesetzlicher Feiertag und die Arbeitnehmer haben automatisch Anspruch auf mindestens 26 gesetzliche Urlaubstage in 2019 für eine Vollzeitanstellung.

Es ist ratsam, die Formulierungen in den Arbeitsverträgen und sonstigen Vereinbarungen auf die Angabe der Urlaubstage und Ruhetage hin zu prüfen.
