Introduction of moral harassment in the Labour Code

The Law of 29 March 2023, published in the Mémorial A n°187 of 5 April 2023, introduces a new chapter in the Labour Code on moral harassment[1]. The Law will come into force on 9 April 2023.

The key points of attention for employers are as follows:

1. New definition of moral harassment:

Moral harassment in the context of labour relations is defined as any conduct which, by its repetition or systematisation, affects the dignity or the psychological or physical integrity of a person.

Attention: behaviour or acts of moral harassment may now also occur outside the employee's usual place of work and working hours (e.g. professional trips, professional training, etc.).

Customers, suppliers and any external person who is connected to the employer can also be authors of moral harassment.

2. Your obligations as an employer:

  • Determine, after informing and consulting the staff delegation or, failing that, all staff, the preventive measures to be taken to protect employees against moral harassment at work (measures adapted to the nature of the activities and the size of the company).
  • Immediately cease any moral harassment of which you are aware through measures.
  • Carry out an internal evaluation in the event of moral harassment of an employee. The staff delegation or, failing that, all staff should be consulted prior to this.

3. Victims and witnesses of harassment may not be subjected to reprisals: any provision or act to the contrary, and in particular any dismissal, is automatically null and void.

4. Involvement of the Labour Inspectorate if the harassment does not stop despite the implementation of preventive measures or if the employer fails to take action.

5. Penalty for non-compliance with your obligations (criminal penalty): fine of EUR 251 to 2,500 (double if repeated within two years).

Introduction du harcèlement moral dans le Code du travail

La Loi du 29 mars 2023, publiée au Mémorial A n°187 du 5 avril 2023, introduit dans le Code du travail un nouveau chapitre en matière de harcèlement moral[1]. La Loi entrera en vigueur le 9 avril 2023.

Les principaux points d’attention pour les employeurs sont les suivants :

1. Nouvelle définition du harcèlement moral :

Le harcèlement moral à l’occasion des relations de travail est défini comme toute conduite qui, par sa répétition, ou sa systématisation, porte atteinte à la dignité ou à l’intégrité psychique ou physique d’une personne.

Attention, les comportements ou actes de harcèlement moral peuvent désormais se manifester également en dehors du lieu de travail habituel du salarié et du temps de travail (par exemple : voyages professionnels, formations professionnelles, etc.).

Les clients, fournisseurs, ainsi que toutes personnes extérieures à l’entreprise en relation avec l'employeur, peuvent également être auteurs d’un harcèlement moral.

2. Vos obligations en tant qu’employeur :

  • Déterminer, après information et consultation de la délégation du personnel ou à défaut de l'ensemble du personnel, les mesures de prévention à prendre pour protéger les salariés contre le harcèlement moral au travail (mesures adaptées à la nature des activités et à la taille de l'entreprise).
  • Faire cesser immédiatement tout harcèlement moral dont vous avez connaissance via des mesures.
  • Procéder à une évaluation interne en cas de survenance d'un comportement de harcèlement moral envers un salarié. Il conviendra de consulter au préalable la délégation du personnel ou, à défaut, l'ensemble du personnel.

3. Les victimes et témoins des actes de harcèlement ne peuvent faire l’objet de représailles: toute disposition ou tout acte contraire, et notamment tout licenciement est nul de plein droit.

4. Implication de l’ITM si le harcèlement moral subsiste après la mise en œuvre des mesures ou si l’employeur s'abstient de prendre les mesures adéquates.

5. Sanction en cas de non-respect de vos obligations (sanction pénale) : amende de 251 à 2.500 euros (double si récidive dans un délai de deux ans).

Einführung von Vorschriften über Mobbing in das Arbeitsgesetzbuch

Das Gesetz vom 29. März 2023, veröffentlicht im Mémorial A Nr. 187 vom 5. April 2023, führt in das Arbeitsgesetzbuch ein neues Kapitel über Mobbing ein[1]. Das Gesetz tritt am 9. April 2023 in Kraft.

Die wichtigsten zu beachtenden Punkte sind Folgende :

1. Neue Definition von Mobbing :

Mobbing am Arbeitsplatz wird definiert als Verhalten, das durch seine Wiederholung oder Systematisierung die Würde oder die psychische oder physische Integrität einer Person verletzt.

Achtung, Mobbingverhalten oder -handlungen können nun auch außerhalb des üblichen Arbeitsplatzes des Arbeitnehmers und der Arbeitszeit auftreten (z. B. bei Geschäftsreisen, beruflichen Fortbildungen usw.).

Auch Kunden, Lieferanten sowie Personen außerhalb des Unternehmens können Mobbingtäter sein.

2. Ihre Pflichten als Arbeitgeber :

  • Nach Information und Anhörung der Personalvertretung oder, falls es keine Personalvertretung gibt, der gesamten Belegschaft, die Präventionsmaßnahmen festlegen, die zum Schutz der Arbeitnehmer vor Mobbing am Arbeitsplatz zu ergreifen sind (Maßnahmen, die an die Art der Tätigkeiten und die Größe des Unternehmens angepasst sind).
  • Dafür sorgen, dass jedes Mobbing, von dem Sie Kenntnis erhalten, sofort über die Maßnahmen eingestellt wird.
  • Die Durchführung einer internen Bewertung bei Auftreten von Mobbingverhalten gegenüber einem Arbeitnehmer. Zuvor sollten Sie die Personalvertretung oder, falls es keine gibt, die gesamte Belegschaft konsultieren.

3. Opfer und Zeugen von Mobbinghandlungen dürfen nicht Gegenstand von Druck sein: Jede gegensätzliche Bestimmung oder Handlung, insbesondere jede Kündigung, ist von Rechts wegen nichtig.

4. Einbeziehung der ITM, wenn das Mobbing nach der Umsetzung der Maßnahmen fortbesteht oder wenn der Arbeitgeber es unterlässt, angemessene Maßnahmen zu ergreifen.

5. Sanktion bei Nichterfüllung Ihrer Pflichten (strafrechtliche Sanktion): Geldstrafe von 251 bis 2.500 Euro (erhöht sich auf das Doppelte bei erneutem Pflichtverstoß innerhalb von zwei Jahren).
