ADMINISTRATIVE AND PUBLIC LAW

Regulations issued by the State of Luxembourg, Administrations, Municipalities, as well as actions taken by agencies have a significant effect on businesses and professionals.

Our team has substantial experience in both the litigation and advisory side. We work with large and small businesses in a wide range of industries to advise on public authorities' decisions. From time to time, we also represent the State, Administrations and Municipalities in matters where their decision is challenged by others.

Key areas of our specialization include:

  • Advice on General Administrative law: assisting in the decision making process, including but not limited to the procedure administrative non contentieuse (PANC).

  • Advice in Public Procurement matters: Public Procurement is a field on its own in administrative law and you need specialist lawyers to assist you to navigate the challenges of this specific field. We cover both the preparation of tender offers, the execution of public procurement agreements and disputes arising in the decision making or the execution process.

  • Equitable reliefs: Administrative law offers the possibility to seek for equitable relief before (recours gracieux) challenging the administrative decision.

  • Administrative Litigation: The administrative procedure law provides for a very specific set of rules to challenge a decision from the administration and we assist clients on a daily basis to offset the hurdles of these procedures.

The team of the administrative law department works closely with the tax department since tax litigation involves Court procedures that follow the administrative procedure law.
